Venezuelan national Rafael Rubio, an employee of the New York City Council, regained his freedom after spending more than five months in an immigration detention center following his arrest during a routine immigration court appointment.

That immigration benefit will remain valid until October of this year.
The New York City Council confirmed that information in a statement.
After several months of legal proceedings and different legal setbacks, Rubio even faced a deportation order.
On May 27, an immigration judge ruled to grant him asylum.
Despite that favorable decision, Rubio remained in custody for several additional weeks.
He was not released until June 19.
His release took place from the Delaney Hall detention center in New Jersey.
The release was the result of continued efforts by his attorneys from Bronx Defenders and representatives from New York City Hall.

Rubio’s legal situation is not over yet.
On June 22, the Department of Homeland Security (DHS) filed an appeal against the decision granting him asylum.
While that process continues, Rubio will remain waiting for the corresponding resolution, according to ABC 7.
After regaining his freedom, he shared the emotional impact he experienced during his months in detention.

“I thought everything was over for me, that my life and my dreams had ended. And what has happened since then is a miracle that I still struggle to believe,” he said.
His statements reflect the uncertainty he faced while remaining under immigration custody.
Now he must continue through the process resulting from the DHS appeal.
The final outcome will depend on how that legal procedure develops.

New York City Council President Julie Menin celebrated the Venezuelan employee’s release.
The lawmaker said Rubio should never have remained detained for more than five months.
“He was unjustly detained for more than five months,” Menin stated.
She also said Rubio followed legal procedures from the beginning.
According to the Council president, the worker deserved to have his case reviewed fairly.
Menin reiterated that city officials will continue supporting him.
“This should never have happened. From the beginning, Rafael followed the rules, complied with the legal process, and deserved to have his case heard fairly and based on its merits,” she said.
She added that the Council will continue supporting Rubio during the appeal filed against the asylum decision.
The case remains open while the legal process initiated by the Department of Homeland Security moves forward.
Rubio’s release ends his detention, but not the immigration dispute that continues in court.

The next step will be the resolution of the appeal filed by DHS.
